Last month, we asked our audience: Which NRC rule governs emergency preparedness? Overall, the most voted answer was 10 CFR 50, with 67 percent of the vote. In second place, 10 CFR 26 received 27 percent. In third place, 29 CFR 1910 received six percent of the vote. Finally, 40 CFR 60 received zero percent of the vote.
The correct answer is 10 CFR 50. Within 10 CFR Part 50 are 10 CFR 50.47, which sets requirements for emergency plans for power reactors, and the newer 10 CFR 50.160, which establishes a performance-based framework for SMRs, non-LWRs, and other new facilities.
