SUBJECT: COMANCHE PEAK NUCLEAR POWER PLANT, UNITS 3 AND 4 COMBINED LICENSE APPLICATION ONLINE REFERENCE PORTAL (TAC RF2695)

Dear Mr. Woodlan:

By letter dated September 19, 2008, Luminant Generation Company LLC (Luminant) submitted an application pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 52 for two combined licenses (COLs) for Comanche Peak Nuclear Power Plant (CPNPP), Units 3 and 4. On December 2, 2008, the U.S. Nuclear Regulatory Commission (NRC) published a Federal Register notice of acceptance for docketing of the application.

To improve the efficiency of the environmental and safety reviews, Luminant and NRC staff discussed the use of an online reference portal that would allow the NRC, Oak Ridge National Laboratory (ORNL), and Information Systems Laboratories (ISL) staff limited read-only access to the basis documents and other reference materials cited in Luminant’s CPNPP, Units 3 and 4 COL application. The online reference portal will allow the NRC staff to audit basis documents to determine whether the information contained in the documents supports the COL application. The NRC staff will formally request documents to be submitted on the docket, which the staff identify as necessary for its analysis of the COL application or development of the EIS. Use of the online reference portal is acceptable as long as the following conditions are met by Luminant:

• The online reference portal will be password-protected, and passwords will be distributed to staff directly involved in the COL review on a need-to-know basis;
• The online reference portal will disable any printing, saving, or downloading functions;
• The online reference portal will be sufficiently secure to prevent staff from printing, saving, or downloading any documents; and
• Staff given password access to the online reference portal will be informed of the conditions of use of the online reference portal by NRC project managers. The conditions associated with the online reference portal must be maintained throughout the duration of the CPNPP COL application review process. Please provide written confirmation that Luminant agrees to the terms and conditions contained in this letter.
